Yep. I was misremembering something he had said a long time ago about having approval rights over merchandising, which may or may not even still apply now that the series has concluded.

Keep in mind, though, that JMS does not own the rights to B5. AOL Time Warner owns the rights; JMS merely has some unknown form of veto/approval over some of what they can do. That's something that would be less likely to pass to his estate.

I think part of the problem is that many people convinced themselves it was going to be bad before seeing it. If you look back at message archives from around that time, you can see a whole lot of negativity about it right up front. After all, JMS had squeezed the arc into the fourth season...
